মুমিনগণ, যখন তোমাদের কাছে ঈমানদার নারীরা হিজরত করে আগমন করে, তখন তাদেরকে পরীক্ষা কর। আল্লাহ তাদের ঈমান সম্পর্কে সম্যক অবগত আছেন। যদি তোমরা জান যে, তারা ঈমানদার, তবে আর তাদেরকে কাফেরদের কাছে ফেরত পাঠিও না। এরা কাফেরদের জন্যে হালাল নয় এবং কাফেররা এদের জন্যে হালাল নয়। কাফেররা যা ব্যয় করেছে, তা তাদের দিয়ে দাও। তোমরা, এই নারীদেরকে প্রাপ্য মোহরানা দিয়ে বিবাহ করলে তোমাদের অপরাধ হবে না। তোমরা কাফের নারীদের সাথে দাম্পত্য সম্পর্ক বজায় রেখো না। তোমরা যা ব্যয় করেছ, তা চেয়ে নাও এবং তারাও চেয়ে নিবে যা তারা ব্যয় করেছে। এটা আল্লাহর বিধান; তিনি তোমাদের মধ্যে ফয়সালা করেন। আল্লাহ সর্বজ্ঞ প্রজ্ঞাময়।
O you who believe! When believing women come to you as emigrants, examine them, Allâh knows best as to their Faith, then if you ascertain that they are true believers, send them not back to the disbelievers, they are not lawful (wives) for the disbelievers nor are the disbelievers lawful (husbands) for them. But give the disbelievers that (amount of money) which they have spent [as their Mahr] to them. And there will be no sin on you to marry them if you have paid their Mahr to them. Likewise hold not the disbelieving women as wives, and ask for (the return of) that which you have spent (as Mahr) and let them (the disbelievers, etc.) ask back for that which they have spent. That is the Judgement of Allâh. He judges between you. And Allâh is All-Knowing, All-Wise.
يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا جَاءكُمُ الْمُؤْمِنَاتُ مُهَاجِرَاتٍ فَامْتَحِنُوهُنَّ اللَّهُ أَعْلَمُ بِإِيمَانِهِنَّ فَإِنْ عَلِمْتُمُوهُنَّ مُؤْمِنَاتٍ فَلَا تَرْجِعُوهُنَّ إِلَى الْكُفَّارِ لَا هُنَّ حِلٌّ لَّهُمْ وَلَا هُمْ يَحِلُّونَ لَهُنَّ وَآتُوهُم مَّا أَنفَقُوا وَلَا جُنَاحَ عَلَيْكُمْ أَن تَنكِحُوهُنَّ إِذَا آتَيْتُمُوهُنَّ أُجُورَهُنَّ وَلَا تُمْسِكُوا بِعِصَمِ الْكَوَافِرِ وَاسْأَلُوا مَا أَنفَقْتُمْ وَلْيَسْأَلُوا مَا أَنفَقُوا ذَلِكُمْ حُكْمُ اللَّهِ يَحْكُمُ بَيْنَكُمْ وَاللَّهُ عَلِيمٌ حَكِيمٌ
Ya ayyuha allatheena amanoo itha jaakumu almu/minatu muhajiratin faimtahinoohunna Allahu aAAlamu bi-eemanihinna fa-in AAalimtumoohunna mu/minatin fala tarjiAAoohunna ila alkuffari la hunna hillun lahum wala hum yahilloona lahunna waatoohum ma anfaqoo wala junaha AAalaykum an tankihoohunna itha ataytumoohunna ojoorahunna wala tumsikoo biAAisami alkawafiri wais-aloo ma anfaqtum walyas-aloo ma anfaqoo thalikum hukmu Allahi yahkumu baynakum waAllahu AAaleemun hakeemun
YUSUFALI: O ye who believe! When there come to you believing women refugees, examine (and test) them: Allah knows best as to their Faith: if ye ascertain that they are Believers, then send them not back to the Unbelievers. They are not lawful (wives) for the Unbelievers, nor are the (Unbelievers) lawful (husbands) for them. But pay the Unbelievers what they have spent (on their dower), and there will be no blame on you if ye marry them on payment of their dower to them. But hold not to the guardianship of unbelieving women: ask for what ye have spent on their dowers, and let the (Unbelievers) ask for what they have spent (on the dowers of women who come over to you). Such is the command of Allah: He judges (with justice) between you. And Allah is Full of Knowledge and Wisdom.
PICKTHAL: O ye who believe! When believing women come unto you as fugitives, examine them. Allah is Best Aware of their faith. Then, if ye know them for true believers, send them not back unto the disbelievers. They are not lawful for them (the disbelievers), nor are they (the disbelievers) lawful for them. And give them (the disbelievers) that which they have spent (upon them). And it is no sin for you to marry such women when ye have given them their dues. And hold not to the ties of disbelieving women; and ask for (the return of) that which ye have spent; and let them (the disbelievers) ask for that which they have spent. That is the judgment of Allah. He judgeth between you. Allah is Knower, Wise.
SHAKIR: O you who believe! when believing women come to you flying, then examine them; Allah knows best their faith; then if you find them to be believing women, do not send them back to the unbelievers, neither are these (women) lawful for them, nor are those (men) lawful for them, and give them what they have spent; and no blame attaches to you in marrying them when you give them their dowries; and hold not to the ties of marriage of unbelieving women, and ask for what you have spent, and kt them ask for what they have spent. That is Allah’s judgment; He judges between you, and Allah is Knowing, Wise.
KHALIFA: O you who believe, when believing women (abandon the enemy and) ask for asylum with you, you shall test them. GOD is fully aware of their belief. Once you establish that they are believers, you shall not return them to the disbelievers. They are not lawful to remain married to them, nor shall the disbelievers be allowed to marry them. Give back the dowries that the disbelievers have paid. You commit no error by marrying them, so long as you pay them their due dowries. Do not keep disbelieving wives (if they wish to join the enemy). You may ask them for the dowry you had paid, and they may ask for what they paid. This is GOD’s rule; He rules among you. GOD is Omniscient, Most Wise.
৯। আল্লাহ্ কেবল তাদের সাথে [ বন্ধুত্ব ] করতে নিষেধ করেন, যারা দ্বীনের ব্যাপারে তোমাদের বিরুদ্ধে যুদ্ধ করে, এবং তোমাদের স্বদেশ থেকে বহিষ্কার করেছে এবং বহিষ্কারে যারা সাহায্য করেছে। তাদের সাথে যারা বন্ধুত্ব করে তারা তো পাপ করে।
১০। হে বিশ্বাসীগণ ! যখন তোমাদের নিকট মুমিন নারীগণ হিজরত করে আসে ৫৪২২, তাদের পরীক্ষা করে নেবে। আল্লাহ্ তাদের ঈমান সম্বন্ধে সবচেয়ে ভালো জানেন। যদি তোমরা নিশ্চিত হও যে ৫৪২৩, তারা মুমিন, তাহলে তাদের আর অবিশ্বাসীদের নিকট পাঠিও না। তারা অবিশ্বাসীদের জন্য বৈধ [ স্ত্রী ] নহে, এবং অবিশ্বাসীরা তাদের জন্য বৈধ [ স্বামী ] নহে। অবিশ্বাসীরা [ মোহর হিসেবে ] তাদের জন্য যা ব্যয় করেছে, তা তাদের পরিশোধ করো। অতঃপর যদি তোমরা মোহর আদায় করে তাদের বিবাহ কর, তোমাদের কোন দোষ হবে না ৫৪২৪। কিন্তু তোমরা অবিশ্বাসী নারীদের সাথে দাম্পত্য সম্পর্ক ধরে রেখো না ৫৪২৫। তোমরা যা ব্যয় করেছে মোহর হিসেবে তা ফেরত চাইবে, এবং অবিশ্বাসীরা যা ব্যয় করেছে তারা তা ফেরত চাইবে। ইহাই আল্লাহ্র বিধান। তিনি তোমাদের মাঝে [ ন্যায়ের সাথে ] বিচার করে থাকেন এবং তিনি জ্ঞান এবং প্রজ্ঞায় পরিপূর্ণ।
৫৪২২। হুদায়বিয়ার সন্ধির জন্য দেখুন ৪৮নং সূরার ভূমিকার ৪র্থ অনুচ্ছেদের ৩ নম্বর শর্ত। হুদায়বিয়ার সন্ধির শর্ত অনুযায়ী স্বামী বা অন্য কোনও অভিভাবকের অধীনের কোনও স্ত্রীলোক যদি মক্কা থেকে পালিয়ে মদিনাতে গমন করে রাসুলের নিকট নিরাপত্তা প্রার্থনা করে, তবে সন্ধির শর্ত অনুযায়ী রাসুল (সা) তার প্রার্থনা মঞ্জুর না করে তাঁকে পুণরায় তার অভিভাবকের নিকট মক্কায় ফেরত পাঠাতে বাধ্য থাকবেন। এই আয়াতটি অবতীর্ণ হওয়ার পূর্বেই মক্কার কোরাইশরা পুনঃপুনঃ তাদের সন্ধির শর্ত সমূহ ভঙ্গ করে থাকে। এরই প্রেক্ষাপটে মদিনার মুসলিমদের জন্য আল্লাহ্র পরবর্তী নির্দ্দেশ অত্যন্ত প্রয়োজনীয় হয়ে পড়েছিলো। সে সময়ে অনেক মোশরেক মক্কাবাসীদের স্ত্রীরা ইসলাম গ্রহণ করেছিলেন, ফলে তারা স্বামীগৃহে এবং সমাজে তাদের বিশ্বাসের জন্য নিগৃহীত হতেন। এদেরই কিছু মুসলিম নারী মক্কা থেকে পালিয়ে মদিনাতে এসে রাসুলের (সা) নিকট নিরাপত্তা প্রার্থনা করেন। এই আয়াতের পরে এসব মহিলাদের মক্কাতে তাদের স্বামীদের নিকট ফেরত পাঠানো বৈধ নয়। কারণ মুসলিম মহিলার সাথে অমুসলিম ব্যক্তির বিবাহ বৈধ নয়। সুতারাং অমুসলিম স্বামী মুসলিম মহিলার অভিভাবক হতে পারে না। তখনই তাঁর স্বামী অভিভাবক হতে পারবেন যখন তিনি ইসলাম গ্রহণ করবেন। এ সব মহিলাদের স্বামীরা তাদের স্ত্রীদের দেয়া মোহরানা হারিয়ে ক্ষতিগ্রস্থ হয়ে বিক্ষুব্ধ হতে পারেন। আর্থিক ক্ষতির কারণে তারা যাতে খারাপ অনুভব না করেন সে কারণে তাদের আর্থিক ক্ষতিকে পরিশোধ করার বন্দোবস্ত করা হয়। এ সব অসহায় মুসলিম নারীদের এ ভাবেই মুসলমানদের আর্থিক খরচের বিনিময়ে রক্ষা করা হয়।
৫৪২৩। মহিলাদের মক্কাতে তাদের অভিভাবকদের নিকট ফেরত না পাঠানোর একটাই শর্ত, আর তা হচ্ছে তারা হবে ইসলাম ধর্মে দীক্ষিত। তারা যে প্রকৃতই মুসলিম তার প্রমাণ কি ? এমনও তো হতে পারে যে একজন অমুসলমান মহিলা তার অত্যাচারী স্বামীর কবল মুক্ত হওয়ার জন্য মিথ্যাচারের আশ্রয় গ্রহণ করছেন। তার মনোজগতের খবর জানবেন একমাত্র আল্লাহ্। যদি তদন্ত সাপেক্ষে প্রমাণ হয় যে তিনি একজন প্রকৃত মুসলিম নারী, তবে মুসলমানদের কর্তব্য তার নিরাপত্তা নিশ্চিত করা, এই তদন্তের ভিত্তি অন্যান্য সংবাদের সাথে যে বিষয়গুলির সংযুক্তি ঘটবে তার উল্লেখ আছে নীচের আয়াত নং ১২ তে।
৫৪২৪। যেহেতু মুসলিম নারীর সাথে অমুসলমানের বিবাহ বৈধ নয়, সুতারাং তাদের কৃত বিবাহ চুক্তি বহাল থাকে না। এক্ষেত্রে তাদের পুনঃর্বিবাহে কোন আইনসঙ্গত বাধা নাই। দেখুন টিকা ৫৪২২।
৫৪২৫। বিশ্বাসী মুসলিম সমাজে অমুসলিম নারীর অবস্থান হবে প্রতিবন্ধী মানুষের ন্যায়। সমাজের কোন কল্যাণকর বা মঙ্গলজনক কাজে সে অবদান রাখতে হবে অক্ষম, তার জন্য সমাজ জীবনের সংস্কৃতি ও কৃষ্টির সাথে একাত্বতা বোধ করা অসম্ভব। আর সামাজিক একাত্বতা ব্যতীত সমাজে সে হয়ে পড়ে একা। এ সব নারীদের সাথে মুসলমানদের বিবাহ আর বৈধ থাকে না। তাদের মক্কাতে ফেরত পাঠাতে হবে এবং তাদের জন্য যে দেনমোহর খরচ করা হয়েছিলো, তা মক্কাতে যিনি তার অভিভাবক তিনি ফেরত দেবেন। মুসলিম নারী, যার কাফের স্বামী, তার জন্য দেনমোহরের যে বন্দোবস্ত করা হয়েছিলো, এ ব্যবস্থা ঠিক তার বিপরীত।
